1. Acceptance of Terms
By accessing or using Von Gstaad services ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Von Gstaad reserves the right to modify these terms at any time. Continued use of the Service following notification of changes constitutes acceptance of the updated terms.
2. Description of Service
Von Gstaad provides derived FX market structure analysis via a programmatic API. The Service delivers covariance matrices, regime classifications, coherence scores, eigenvalue distributions, information sufficiency scores, and mathematical structural metrics across 28 major currency pairs. All data provided is derived and computed — the Service does not provide raw market data, trading advice, or investment recommendations. Data is provided for informational and research purposes only.
3. No Financial or Trading Advice
Nothing provided by Von Gstaad constitutes financial advice, trading advice, investment advice, or any other form of regulated financial service. Von Gstaad is a data and analytics service only. Users are solely responsible for their own trading and investment decisions. Von Gstaad bears no liability for any financial outcome resulting from use of the Service.
4. API Access and Usage
API access is granted subject to the tier selected at subscription. Each tier carries defined rate limits (requests per day) and endpoint access rights. Rate limits are enforced technically and are non-negotiable. Circumventing rate limits — including by using multiple API keys, credential sharing, or automated request cycling — is a material breach of these Terms and will result in immediate account termination without refund. API keys are personal and non-transferable.
5. Acceptable Use
You agree not to: (a) use the Service to build a competing data product by repackaging or reselling Von Gstaad outputs; (b) reverse-engineer, extract, or infer Von Gstaad's methodology from API responses; (c) use the Service in any way that violates applicable law; (d) attempt to exceed rate limits or circumvent access controls; (e) share API credentials with third parties. Violation of these conditions results in immediate termination without refund.
6. Service Availability
Von Gstaad provides the Service on a best-effort basis. No uptime guarantee or service level agreement is offered under the free or standard tiers. Enterprise tier clients may negotiate an SLA separately. Planned maintenance will be announced where practicable. Von Gstaad is not liable for losses arising from service interruption.
7. Payment and Billing
Paid subscriptions are billed monthly or annually as selected. Payment is processed by Paddle.com Market Limited ("Paddle"), acting as Merchant of Record. By subscribing, you agree to Paddle's terms of service in addition to these Terms. Von Gstaad does not store payment card data. Prices are listed in EUR. Subscriptions renew automatically unless cancelled before the renewal date.
8. Termination
Von Gstaad may suspend or terminate access immediately and without notice in cases of: breach of these Terms, suspected abuse or fraudulent activity, or non-payment. Users may cancel their subscription at any time through the customer portal. Termination does not entitle the user to a refund except as described in the Refund Policy.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Von Gstaad and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of profits, arising from use of or inability to use the Service. Total liability shall not exceed the amount paid by the user in the 30 days preceding the claim.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and applicable national law. Any disputes shall be resolved by good-faith negotiation first, failing which through the competent courts of the jurisdiction of Von Gstaad's registered operator.
